If the roof height violates the building code in your area then it is a violation.Sounds like your neighbors have a case.
You may have recourse against the architect for damages. Check with your local shyster.

Drawings and plans change constantly for several reasons: to meet codes, standards and regulations; someone’s personal preference(s); structural purposes; and so on.
I don’t know anything about the legal issues but, plans change all the time.

If the architect drew it a certain way, the contractor should build it that way. An architect’s drawings show the end product. The end product should look like the drawings. If it doesn’t, the drawings weren’t followed. If there was a conflict in the drawings, the contractor should have caught it before it got built wrong.
